Changes to the Bar Exam During COVID-19

The COVID-19 pandemic created some unforeseen complications for future lawyers. In a traditional year, recent law school graduates would be preparing for the bar exam. The ongoing pandemic, however, means that they have to wait for the final verdict from their respective states on how the exams will be facilitated. Here are some plans already in motion.

The Diploma Privilege

Washington, Utah, and Oregon have opted for a "diploma privilege" to ease growing pressure and contain the disease's spread. With this option, students who have completed law school can practice law in their state without sitting for the bar exam. However, California is reluctant to take this approach. The state’s Supreme Court recently made a decision that will allow prospective students to take an online exam. Alternatively, students can opt for a provisional license valid for two years.

Online Options

The recent surge of COVID-19 cases across different states has made taking online bar exams a viable alternative. Large gatherings of aspiring lawyers can easily create a perfect setting for new infections, a situation that many states are keen on avoiding. Florida and Louisiana have already taken steps to provide the bar exam online. Law school graduates should begin familiarizing themselves with online versions of the exam so that they’ll have an easier time registering and taking the test.

Postponing the Bar Exams

Some states are still pushing to have students take the exam in-person. Such states are considering putting off the exam until early 2021 or late fall, while others are considering implementing different precautions, including robust cleaning protocols and proper social distancing to facilitate in-person gatherings. Outdoor venues may also be an option in extreme cases.
